These purchase terms apply to all sales of goods and services from Boatparts.no AS to consumers.
The purchase terms, together with your order, confirmed through an order confirmation, constitute the total contract basis for the purchase.
The purchase conditions and other information on Boatparts.no AS are only available in Norwegian, Swedish, Danish or English. The conditions are numbered consecutively by changes. We will keep information about which version of the terms of sale applies to your order.
- 1: To be able to shop on boat-parts.net you must have turned 18 years.
- 2: If you are under the age of 18, you can only act on postal charges or pay for pickup. You can also get an adult, such as a guardian, to trade for you.

The Consumer Purchase Act, the Right of Withdrawal Act, the Marketing Act, the Personal Data Act, the e-commerce Act and the Credit Purchase Act.
In the event of a dispute, we will follow the decisions of the Consumer Complaints Committee.
Where these Terms of Purchase impose requirements for writing, this is fulfilled by using e-mail, text message for mobile phone (SMS), letter, fax or the like. If you want us to send any reminders, claims etc. to you by email, text message or similar electronic communication methods, you must explicitly accept this by ticking off a checkbox or the like.

2. Implementation of purchases in the Online Store
To make you feel confident about how to order / shop in our online store, we have described the purchase process, which consists of the following items:

3. Order and contract process
Your order is binding when the order is registered on our server (computer). We are also bound by your order if this does not deviate from what is offered by us in our online store (Exceptions may occur, see section 4), our marketing or otherwise. However, you have the right to withdraw from the purchase of the Right of Withdrawal Act, see more in point 11 of the agreement.
When we receive your order, we will confirm the order and automatically send you an order confirmation / copy of invoice to you. Carefully read the order confirmation / copy of the invoice when you receive it, and check if the order confirmation / copy of the invoice is in accordance with the order.
Deviations between your order and the order confirmation / Copy of invoice are considered a new offer from us, which you can accept or refuse. However, you have the right to claim your original order if this is in accordance with what we have offered. Exceptions may occur, see section 4.
4. Information provided in the online store
We strive to provide our customers with accurate information about our products as possible. We reserve for typing errors and any price changes. Images used on our pages are illustrative and may deviate from the actual appearance / printing errors of the product, which may imply that we cannot deliver in accordance with information provided in our online store, marketing or otherwise.
Furthermore, we reserve the right to cancel your order or part of it, if the product is sold out. In case of sold-out situations, you will receive notice of this, together with information about what we can offer instead. You will have the opportunity to accept our new offer with the changes we make regarding your order or cancel your order
5. 30 day price promise, applies only to goods that are traded on our webshop
We give a 30day price promise! If you find the same product at a lower price, we will do our best to match or have a better price.
- If you can buy the same product at a lower price than you paid with us within 30 days after the purchase date with us, we will refund you the difference. You must document the lower price by presenting an ad, customer opinion, product catalog or the like.
- The price promise does not apply to:
- Foreign prices / stores
- Special Offers
- Promotions
- Boats
- Engines
5a. Pricing
All prices are inclusive of VAT and any environmental fee. The total cost of the purchase will appear before the order and include all expenses associated with the purchase as expenses for postage, shipping, packaging etc.
Prices are constantly changing, and we therefore reserve the right to change prices as a result of changed prices from our suppliers.
We also reserve the right to change prices for products that are in promotions and the like.
Any price changes that occur after the order date that is not due to errors (see below) will not have retroactive effect.
If there have been typing or printing errors of substantial size from the Boatparts.no AS side, in ads and the like. and / or in the online store, Boatparts.no AS can unilaterally change, delete or reject orders. This applies even if the customer has received an order confirmation or the like. However, such errors must be corrected within a reasonable time after the error is detected
6. Payment
The purchase price can, at your option, be settled through E-invoice, bank, Visa, invoice or credit card.
When using a card, the purchase price will be reserved on the card when ordering. If reservation cannot be made, we reserve the right to cancel the booking. You will receive information on any such cancellation. The card is charged - the same day shipping is made.
Unclaimed packages will be charged a fee of NOK 350.- to cover our expenses for handling and shipping. The right of withdrawal is not triggered because the package is not retrieved.
In case of non-payment, the claim will, after prior notice, be sent for collection. This only applies to customers over the age of 18.
For partial deliveries, only the partial delivery is charged. In case of late payment, interest accrues in accordance with the Delay Interest Act (Act on interest on late payment, etc.) The interest rate is set by the Ministry of Finance twice a year. ”
7. Delivery and delay
Delivery of the products takes place in the manner, at the place and until the time specified on the order confirmation / Copy of invoice. We have the risk of the products until they are taken over by you, that is, when you have received the products in your possession. All delivery times stated by us must be considered as indicative. By delivery time is meant the time of arrival of goods to our warehouse. Time taken for picking, packing and possibly production comes in addition before submitting the shipment to the carrier. When time is stated in the number of days, weekdays are meant and the charterer's time always comes in addition. We reserve the right to deviate and or change the stated delivery time without further notice.
If the delivery of the products is delayed, we will provide you with information as soon as we have knowledge of it, together with information about and possibly when delivery can take place, or if the product (s) are sold out.
Depending on the nature of the products and the length of the delay, you may, in the circumstances, hold back the purchase price, demand delivery, claim compensation or cancel the agreement.
8. Examination of the products
Once you have received the products, as soon as you have the opportunity, you should check whether the delivery is in accordance with the order confirmation / copy of the invoice, whether the products have been damaged during transportation, or if the products otherwise have errors or defects.
9. Complaints - The Consumer Purchase Act of 21 June Nr. 34 2002
If a defect or defect is discovered, the consumer must within a reasonable time after he or she discovered or should have discovered it, notify the seller that he or she will invoke the defect (complaint). The deadline for advertising is nevertheless not shorter than two months from the time the consumer discovered the defect. Complaints must be made no later than two years after the consumer took over the thing. If the thing or parts of it are intended to last significantly longer in normal use, the deadline for advertising is five years. If the consumer does not advertise on time, the right to make the defect is lost. A deficiency that appears within six months after the consumer took over (normally the time of delivery) is supposed to have existed at the risk of the risk.

Confirmation of receipt of the complaint inquiry will be sent to the email address that the customer has registered on his customer account. In the confirmation, it will also be informed if special terms / handling are required from the buyer side ifm. Return of the item.
If there is a defect in the item and the consumer has complained within the aforementioned deadlines, the consumer may make the following deficiencies remedies:
- Keep the purchase price back
- Under certain conditions, choose between correction or replacement
- Require lifting if the defect is not insignificant (assuming the item is in the same condition, quantity and has original packaging)
- Demand a refund
If the seller's correction or replacement will cause the consumer to be cut off for more than a week from using the item (we interpret this from the item being acknowledged by boatparts.no), the consumer may, under certain conditions, have the right to request the replacement item. for the seller's bill. As a general rule, the seller is not entitled to make more than two attempts at rectification or replacement for the same defect.
If there is no defect, the seller may only demand payment for inquiries that have been necessary to determine whether there is a defect and payment for the repair of the thing, if the seller has explicitly informed the consumer that he or she himself must cover such costs.
If the customer initiates measures on his own initiative to remedy the defect beyond what may have been agreed with Boatparts.no AS, Boatparts.no AS does not pay these expenses.
10. Warranty
Our guarantees do not imply any limitations on the warranty period for goods under the Consumer Purchase Act. The complaint deadline follows the manufacturers' warranties or one years after you took over the goods. See also point 9.
11. 30 day open purchase
Applies only to goods that are traded on our webshop and to customers in Norway. With us you get the money back if you regret the purchase.

11A. Refund
By pre-paid amount where the customer raises the purchase or due to delayed delivery and complaint. Repayment is done within 14 working days.
12. Personal information
Our customers are concerned that Boatparts.no AS handles personal information in a safe manner. Below you will get a more detailed description of how we handle this information.
When you shop with us, we store your name, address, phone number and e-mail address. These are information we need to deliver the goods to you via the carrier you choose, and to contact you about the conditions of the order. We are also required to keep this information in connection with accounting, fee handling and any warranty / return handling, so that this history cannot be deleted. For security reasons, we also keep the IP address used to register the order. This information is also available on the account pages.
Speed dials are not stored by Boatparts.no AS beyond what is necessary to ensure efficient handling of any load issues, reservation cancellation and credit.
We also collect and store log data as to which categories and products you look or search, in order to learn what our customers are concerned with, as well as improve product selection and offers. This information is also used to enable you to display related products or to send you related offers (if explicitly requested). The information is also used to produce traffic statistics for eg. capacity planning.
We offer a variety of email lists to receive various types of information and offers. It is voluntary to receive this, and one must explicitly sign up for registration or on the account pages. It is also easy to opt out of the mailing lists from the account page.
Customers who have shopped over the past two years can be sent information in the mail when this is published.
Boatparts.no AS does not sell personal information to third parties, nor do we exchange or forward such information with third parties.

13. Sales Mortgages
"We have sales mortgages on the delivered products until the purchase price including interest and costs is paid in full."
15. Customer's duties
Whoever is registered as a customer at Boatparts.no AS, is responsible for payment of the benefits Boatparts.no AS or Boatparts.no AS their partners provide under these terms. The responsibility also includes others' use of the customer's access, including unauthorized use, provided if that it cannot be demonstrated that the unauthorized use has been made possible through negligence on the part of the Boatparts.no AS
16. Extraordinary circumstances
Boatparts.no AS is only responsible for loss for the item, if errors or defects have been detected during delivery. This does not apply, however, if Boatparts.no AS proves that the defect is due to off-Boatparts.no AS control or that Boatparts.no AS could reasonably be expected to avoid or overcome the consequences.
Boatparts.no AS is not responsible for indirect losses due to deficiencies unless the loss is caused by gross negligence or intent by Boatparts.no AS.
Under no circumstances should the liability exceed 50% of the purchase price.
In the case of consumer purchases, the terms cannot be inferior to the terms of the Act, cf. Act on Consumer Purchases of 2002-06-21 No. 34.
17. Change in terms
Boatparts.no AS reserves the right to change these terms, including as a result of changes in legislation.
18. Force major
If Boatparts.no AS is prevented from delivering or making any compulsory redistribution, or such a supply obligation becomes unreasonably burdensome as a result of labor dispute or any other circumstance where the parties cannot dispose of it such as fire, war, mobilization or unforeseen similar military requisition , fittings, currency restrictions, rebellion and riots, scarcity of means of transport, general commodity scarcity, restriction of the supply of power, and deficiencies in or delays of supplies from subcontractors or manufacturers due to such circumstances referred to in this paragraph are exempted. for all other responsibilities than in complaint cases and credit it to the defective item's associated purchase price.
19. Disputes and applicable law
The parties shall endeavor to resolve any disputes amicably. If this does not succeed, you can bring the case to the Consumer Council. Disputes on the grounds of the conditions and related provisions, as well as disputes relating to them in the aforementioned and where of the following legal matters fall under the ordinary courts, with Oslo District Court as the venue. 20. Copyright
All content on these websites is owned by Boatparts.no AS or a subcontractor of the said property and is protected by copyright, marketing and trademark laws. This means that trademarks, company names, product names, information about products, including mention of the products and the weight, images / graphics, design and layout and other content of these web sites under any circumstances cannot be downloaded, copied or otherwise used without explicit permission by law or by express written consent of Boatparts. no AS.
